These Terms and Conditions (“Terms”) govern your access to and use of the KadiMudi website located at https://www.kadimudi.lk (the “Platform”). The Platform is operated by ZikZen Solutions (Pvt) Ltd (“we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not continue to use KadiMudi.
These Terms should be read together with our Privacy Policy and Refund Policy.
1) Definitions
“User”, “you”, “your” refers to any person who accesses or uses the Platform. “Listing” or “Ad” means any advertisement, content, images, text, price, and contact details submitted to the Platform. “Paid Services” means any paid features such as featured listings, boosts, priority placements, or other promotional packages offered on the Platform.
2) Platform Overview
KadiMudi is a classified advertising platform that allows users to post and view ads and communicate with other users. Unless explicitly stated, KadiMudi is not a party to transactions between buyers and sellers. We do not guarantee that an item will be sold, that a buyer/seller is genuine, or that listings are accurate. You are responsible for performing your own checks before meeting or completing any deal.
3) Eligibility
You must be at least 18 years old to create an account, post ads, purchase Paid Services, or use the Platform in a way that forms a legally binding agreement. By using KadiMudi, you confirm you have the legal capacity to accept these Terms.
4) User Accounts
To access certain features, you may need to create an account. You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
You must notify us immediately if you suspect unauthorized access to your account. We may suspend or terminate accounts that violate these Terms, platform rules, or applicable law.
5) Posting Rules and User Responsibilities
By submitting a Listing, you confirm that:
- You have the legal right to sell/offer the item or service described (where applicable).
- The Listing information is accurate, not misleading, and does not omit important facts.
- You will not post prohibited items, illegal content, or anything that violates Sri Lankan law.
- You will not post content that is abusive, hateful, defamatory, obscene, or invasive of privacy.
- You will not upload malware, spam, automated content, or engage in scraping/abuse of the Platform.
We reserve the right (but are not obligated) to review, reject, edit, remove, or disable any Listing or account that we believe violates these Terms, our rules, or user safety.
6) Prohibited Content and Items
You must not use the Platform to advertise, request, or promote illegal or restricted goods/services, stolen property, fraud/scams, or anything that may harm users or the public. We may remove such content immediately and may report violations to relevant authorities where required.
7) User-to-User Communication and Safety
The Platform may allow messaging or contact between users. You are responsible for your interactions with other users. We recommend meeting in public places, verifying identity where appropriate, and avoiding advance payments to unknown parties. KadiMudi is not responsible for disputes, losses, or damages arising from user-to-user interactions.
8) Paid Services, Pricing, and Availability
KadiMudi may offer Paid Services such as featured listings, boosted ads, priority placements, subscriptions, or other promotional packages. Prices, duration, and benefits (if any) will be shown at the time of purchase. We may change pricing and package features at any time.
Purchasing Paid Services does not guarantee a sale, lead, response, or outcome. It only provides the promotional feature(s) described at checkout.
9) Payments
Online payments for Paid Services are processed via trusted third-party payment gateways and banking/payment partners (such as PayHere, Koko, and/or other providers offered at checkout). We do not store your full card details on our servers. Your payment may be subject to the payment provider’s own terms and policies.
10) Refunds and Cancellations
Refund eligibility (if any), processing timelines, and rules for Paid Services are governed by our Refund Policy.
Unless stated otherwise in the Refund Policy or required by applicable law, Paid Services (such as featured/boosted placements) may not be refundable once the promotion has started or the service has been delivered/activated.
11) Intellectual Property
Unless otherwise stated, KadiMudi and/or its licensors own the intellectual property rights for all material on the Platform, including logos, branding, design, and platform content. All rights are reserved. You may use the Platform for personal and lawful purposes only, subject to these Terms.
12) User Content License
When you post content (including Listings, images, and text), you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and promote that content as necessary to operate and market the Platform. You confirm you have the rights to grant this license.
13) Third-Party Links and Services
The Platform may contain links to third-party websites, ads, or services. We are not responsible for their content, terms, or privacy practices. Accessing third-party services is at your own risk.
14) Cookies
We use cookies and similar technologies for platform functionality, analytics, and user experience improvements. By using KadiMudi, you agree to our cookie usage as described in our Privacy Policy.
15) Limitation of Liability
To the maximum extent permitted by applicable law, ZikZen Solutions (Pvt) Ltd and KadiMudi shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform, your Listings, your communications, or any user-to-user transaction.
We do not guarantee continuous availability or error-free operation of the Platform, and we are not responsible for losses caused by outages, technical issues, third-party service failures, or unauthorized access beyond reasonable security measures.
16) Indemnification
You agree to indemnify and hold harmless ZikZen Solutions (Pvt) Ltd, its directors, employees, and partners from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your Listings, your content, or your misuse of the Platform.
17) Suspension and Termination
We may suspend or terminate your access to the Platform at any time without prior notice if we believe you have violated these Terms, engaged in fraud, harmed users, or used the Platform unlawfully. Upon termination, your right to use the Platform ceases immediately.
18) Changes to These Terms
We may update these Terms from time to time to reflect changes in our operations, legal obligations, or services. The updated Terms will be posted on this page with an updated “Last Updated” date. Continued use of the Platform after changes means you accept the revised Terms.
19) Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising under or in connection with these Terms shall fall under the jurisdiction of the competent courts of Sri Lanka.
